TERMS AND CONDITIONS OF THE PROVISION OF SERVICES OF

THE ELECTRONIC STORE GDAY.LT

1. DEFINITIONS

1.1. Seller - MB Geros dienos kava, registered office address Jankiškių st. 2-218, LT-02300 Vilnius, Lithuania, company registration code 304939070, VAT no. LT100014232010, contacts: labas@gday.lt, +37067256994.
1.2. Gday.lt is an electronic store at https://www.gday.lt.
1.3. Buyer - 1) a natural person who can enter into transactions in accordance with valid legal acts, who buys goods for personal use (not for business purposes), 2) a legal entity of the Republic of Lithuania who buys goods as an end user (intending to use the goods for representational or other purposes not related to resale of goods or their use for the purposes of business, production, provision of services; 3) duly authorized representatives of all the above-mentioned persons.
1.4. Parties - Buyer and Seller together.
1.5. Seller's partner - a legal entity: 1) used to fulfill the Buyer's order; 2) with which joint actions or projects are carried out on Gday.lt, on the web pages of this legal entity or in any media, in which the action or project of Gday.lt and this legal entity will be described, published.
1.6. The rules are these terms and conditions of the provision of services of the electronic store gday.lt.
1.7. Product - everything that is sold in the Gday.lt online store: coffee beans for home and coffee accessories.

2. GENERAL PROVISIONS 

2.1. These Rules are a binding legal document for the Parties, which determine the rights and obligations of the Parties, the conditions for purchasing and paying for goods, the procedure for the delivery and return of goods, and other conditions related to the purchase and sale of goods on Gday.lt.
2.2. The seller reserves the right to change, supplement, or amend the Rules at any time. The new version of the Rules enters into force after its publication on Gday.lt. Buyers have the opportunity to familiarize themselves with the current version of the Rules on the Gday.lt website, and are also informed each time during the purchase of Goods.
2.3. All persons specified in p. 1.3 of these Rules have the right to register and buy goods on Gday.lt, having confirmed that they are familiar with the Rules (clause 2.4 of the Rules). Buyers, confirming familiarity with the Rules, at the same time confirm that they have the right to buy goods on Gday.lt, i.e. corresponds to the concept of Buyer specified in the Rules.
2.4. The buyer gives his familiarity with the Rules and his consent to comply with them by ticking the box next to the statement: "I have familiarized myself with the rules for the sale of goods of the Gday.lt electronic store and I AGREE WITH THEM". The Buyer has the option to agree or disagree with the statement specified in this clause of the Rules when purchasing in the online store Gday.lt.
2.5. If the Seller has the right or obligation to provide the Buyer with information or documents by e-mail, in all cases, the Buyer is responsible for providing the Seller with a working e-mail address belonging to the Buyer.

3. ORDERING GOODS, CONCLUSION OF A PURCHASE-SALE AGREEMENT

3.1. The legal relationship of purchase and sale between the Seller and the Buyer is established and the purchase and sale agreement (hereinafter - the Agreement) between them is considered concluded from the moment when the Buyer, having chosen the purchased product(s) in the Gday.lt electronic store and formed the goods cart, completes all steps of the order.
3.2. Customer orders are registered and stored in the Gday.lt online store database on the Wix.com platform in accordance with the rules of the Wix.com platform.

4. BUYER'S RIGHTS

4.1. The buyer has the right to buy goods in the electronic store Gday.lt in accordance with the procedure established in these rules.
4.2. The buyer has the right to refuse the order in accordance with the procedure established by these Rules.
4.3. The buyer has the right to cancel the Agreement concluded online with Gday.lt, but no later than within 14 (fourteen) days from the day of delivery of the goods. Excluding food products.
4.4. The buyer has the right to exchange or return the purchased goods in accordance with the procedure established by these Rules.
4.5. The buyer has other rights provided for in these Rules, the Privacy Policy, and the legal acts of the Republic of Lithuania.

5. SELLER'S RIGHTS

5.1. The Seller has the right to suspend or terminate the operation of Gday.lt. In this case, all accepted and confirmed orders of Buyers are completed and new orders are not accepted.
5.2. The Seller has the right to cancel the Buyer's order when:

5.2.1. The Buyer does not pay for the goods on time,

5.2.2. The product is no longer in stock,

5.2.3. The buyer submits a request to cancel the order. For food products - no later than within 1 (one) working day from the payment of the order,

5.2.4. The Buyer does not comply with the Buyer's obligations provided in these Rules and/or the legal acts of the Republic of Lithuania relevant to the transaction.

5.3. When the Buyer chooses the intended payment method or the intended delivery method, the Seller, in the event of uncertainty regarding the information provided in the order, has the right to contact the Buyer using the contacts specified in the order.
5.4. The seller has other rights provided for in these Rules or legal acts of the Republic of Lithuania.

6. BUYER'S OBLIGATIONS

6.1. The buyer must pay for the purchased goods on time and accept them in accordance with the procedure set forth in these Rules.
6.2. The buyer undertakes to store and not transfer to third parties his login data to the electronic store Gday.lt. The responsibility for the consequences arising from improperly stored login data rests with the Buyer.
6.3. Electronic store's Gday.lt Buyers must familiarize themselves with these Rules, as well as comply with them and other conditions clearly indicated in the electronic store, and not to violate the laws of the Republic of Lithuania.

7. SELLER'S OBLIGATIONS

7.1. The seller undertakes to make it possible to use the services of the electronic store, the operating conditions of which are determined by these Rules and other conditions stipulated by Gday.lt.
7.2. The Seller undertakes to deliver the goods purchased by the Buyer to the specified address (they are not delivered to the Curonian Spit) in accordance with these Rules.
7.3. The Seller undertakes to respect the Buyer's privacy right to his personal information, i.e. Personal data of the Buyer shall be processed only in accordance with the Rules, Privacy Policy and legal acts of the Republic of Lithuania.
7.4. Under the conditions stipulated in the rules, the Seller undertakes to deliver the goods ordered by the Buyer and to accept the goods returned by the Buyer.
7.5. When the buyer returns the goods, the Seller undertakes to return the money paid by the buyer within 10 (ten) working days from the day of returning the goods to the Seller.

8. PRICES OF GOODS, TERMS AND PROCEDURE OF PAYMENT FOR GOODS

8.1. The prices of goods in the Gday.lt online store are indicated in euros with VAT.
8.2. The buyer pays for the purchased goods in one of the following ways:
8.2.1. By manual transfer - after choosing this payment method, the Seller sends the prepayment invoice to the Buyer to the e-mail address specified during the purchase. The product is prepared and sent to the Buyer only after receiving the payment.
8.2.2. Payments using electronic banking services of Swedbank, Seb, Luminor, Citadele and Šiaulių bankas. Settlements are possible in euro currency. Payments are processed using the MakeCommerce.lt payment platform.

8.2.3. By transfer from the PayPal account in the e-shop.

 

9. DELIVERY AND COLLECTION OF GOODS

9.1. After choosing the delivery service, the Buyer undertakes to provide the Seller with the exact delivery address.
9.2 The buyer undertakes to receive the goods himself or to designate another consignee.
9.3. The Seller or his authorized representative can deliver the goods to the Buyer or the person designated by them.
9.4. If the Buyer chooses a courier service during the order:
9.4.1. The buyer undertakes to indicate the exact place of delivery of the goods.
9.4.2. The buyer undertakes to accept the goods himself. When accepting goods, it is necessary to present a valid personal identification document (identity card, passport or new model driver's license). If the Buyer cannot receive the goods himself, and the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims to the Seller regarding the transfer of the goods to the wrong person.
9.5. You can familiarize yourself with the delivery and shipping conditions here.
9.6. The seller reserves the right to change the delivery fee and the amount of the purchase, from which delivery is free. Valid rates are indicated in the order creation window so that the Buyer has the opportunity to familiarize themselves with them before confirming the order.
9.7. Goods are sent to the Buyer or the person indicated by him at the specified address after receipt of payment, therefore the delivery period starts from the receipt of payment for the item(s).
9.8. The seller undertakes to make every effort to deliver the purchased item as soon as possible.
9.9. The seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of third parties or due to circumstances beyond the control of the Buyer.
9.10. After receiving the goods at the specified address, the Buyer must check the condition of the shipment and the goods(s) together with the Seller or his authorized representative and sign the invoice, waybill or other document of delivery and acceptance of the shipment. After the buyer signs the invoice, waybill or other document of delivery and acceptance of the shipment, it is considered that the shipment has been delivered in a suitable condition, and there are no damage to the goods, the basis of which cannot be attributed to a factory defect, as well as discrepancies in the product(s) assembly (such as can be determined by inspecting the goods outside) is not available. Upon noticing that the package of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the product(s) is damaged and/or the product(s) is not properly assembled, the Buyer must note this on the invoice, waybill or in another shipment transfer and acceptance document and, in the presence of the Seller or his representative, draw up a free-form shipment and/or product(s) violation (non-conformity) act.
9.11. The buyer has failed to comply with Rule 9.10. specified actions, the Seller is released from liability towards the Buyer for damage to the goods, if the basis for the occurrence of such damage is not a factory defect, and for inconsistencies in the composition of the goods, if these inconsistencies can be determined by inspecting the outside of the goods.
9.12. The characteristics of all goods sold are indicated in the description attached to each item. The seller is not responsible for the fact that the color, shape, smell or other parameters of the goods in the online store may not correspond to the real size, shape, color of the goods, the Buyer's imagination due to the characteristics of the monitor used by the Buyer, the Buyer's subjective assessment.
9.13. The risk of accidental breakage or damage of the goods passes to the Buyer from the moment the goods are handed over to the Buyer.

 

10. COFFEE SUBSCRIPTIONS

10.1. The buyer can purchase two types of coffee product subscription.
10.1.1. Coffee flavor subscription is a one-time payment service, where the Seller delivers the Product to the same address of the recipient on the scheduled schedule. The duration of this service is 4 months and it is not renewable.
10.1.2. A coffee subscription is a recurring purchase of one product, for which funds are debited from the Buyer's account every month. Payment partner - Fondy.io. The coffee subscription has no expiration date, i.e. will continue monthly until terminated. Coffee subscription termination conditions are as follows:
10.1.2.1. The buyer no longer wishes to continue the subscription. The buyer must inform the seller about the desire to cancel the subscription. This can be done by contacting e-mail labas@gday.lt or phone no. +37067256994. In this case, the subscription is immediately terminated and funds are no longer debited from the Buyer's account. Funds for write-offs made before the moment of informing the Seller are not returned. Products are delivered for all paid months.
10.1.2.2. If the ordered product is no longer available, the subscription is terminated by the Seller as soon as reasonably possible. The seller must inform the buyer about the termination of the subscription and return the paid funds for all months when the service is not provided no later than within 10 (ten) working days from the date of termination of the coffee subscription.

 

11. GIFT CARDS

11.1. The buyer can purchase a gift voucher. The digital gift voucher is sent to the specified email address,
11.2. The coupon can only be issued at gday.lt e. in the store. For this, you need to enter the unique coupon number in the discount code window - in the payment section. The coupon is valid for one purchase.
11.3. The coupon is valid for 365 days.

 

12. FINAL PROVISIONS

12.1. These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania and the European Union.
12.2. Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.
12.3. All disagreements arising from the implementation of the Rules are resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
